1. Service Description

SmartTrader ("the Service," "we," "us," "our") is an AI-powered market analysis platform that provides trading intelligence tools, including but not limited to: AI-driven market scans, conviction scoring, pattern detection, money flow analysis, portfolio tracking, and paper trading simulation.

The Service is designed to provide market analysis tools for informational and educational purposes. By using SmartTrader, you agree to these Terms of Service ("Terms").

2. Eligibility

You must be at least 18 years old to use SmartTrader. By creating an account, you represent that:

• You are at least 18 years of age
• You are legally able to enter into binding agreements
• You are not barred from using the Service under applicable law
• You reside in a jurisdiction where accessing financial market information is legal

3. Account Terms

• One account per person. Multiple accounts may be terminated.
• You are responsible for maintaining the security of your account credentials.
• You must provide accurate and complete registration information.
• You are responsible for all activity under your account.
• Notify us immediately of any unauthorized access to your account.
• We reserve the right to suspend accounts that violate these Terms.

Past performance of any analysis, signal, or scoring system does not guarantee future results. Trading and investing in financial markets involves substantial risk of loss. You may lose some or all of your invested capital. SmartTrader makes no guarantees, representations, or warranties regarding the accuracy, profitability, or reliability of any analysis provided.

6. Paper Trading

SmartTrader includes paper trading (simulated trading) functionality. Paper trading uses simulated money and does not involve real financial transactions. Results from paper trading do not reflect actual trading results and should not be used as an indicator of future real-money performance.

SmartTrader does not integrate with any brokerage and does not facilitate real money trading. Any future brokerage integration will be clearly disclosed and subject to additional terms.

7. AI Limitations

SmartTrader uses artificial intelligence and machine learning models. You acknowledge that:

• AI-generated analysis may contain errors, inaccuracies, or hallucinations
• AI models may produce different results for the same inputs at different times
• AI analysis is probabilistic and should not be treated as fact
• Past accuracy of AI models does not guarantee future accuracy
• AI outputs should be independently verified before acting upon
• We do not guarantee the availability, accuracy, or timeliness of AI features

8. Market Data Limitations

Market data displayed on SmartTrader may be delayed, incomplete, or inaccurate. Data is sourced from third-party providers and is provided "as-is" for informational purposes only. We do not guarantee the accuracy, completeness, or timeliness of any market data. Do not rely solely on SmartTrader data for trading decisions.

9. Subscription Terms

• Premium subscriptions auto-renew at the end of each billing period unless cancelled.
• You may cancel at any time. Access continues until the end of the current billing period.
• No refunds for partial billing periods, except as required by applicable law.
• We may change pricing with 30 days advance notice.
• Payment is processed by LemonSqueezy. We do not store your payment card details.
• Failed payments may result in service interruption after a grace period.

10. Intellectual Property

Our Content: All SmartTrader software, algorithms, AI models, user interface designs, documentation, and platform content are owned by SmartTrader and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

Your Content: You retain ownership of data you create on the platform (watchlists, notes, trade journals). You grant us a limited license to store and process this data to provide the Service.

11. Prohibited Uses

You may not:

• Resell, redistribute, or commercially exploit SmartTrader data or analysis
• Use automated scraping, bots, or similar tools to extract data
• Circumvent subscription restrictions or access premium features without payment
• Share account credentials or allow unauthorized access
• Use the Service for market manipulation or any illegal activity
• Attempt to reverse-engineer, decompile, or extract our algorithms or AI models
• Interfere with or disrupt the Service or its infrastructure
• Use the Service in any way that violates applicable laws or regulations

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMARTTRADER SHALL NOT BE LIABLE FOR ANY TRADING LOSSES, INVESTMENT LOSSES, LOST PROFITS, OR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination.

You may terminate your account at any time through account settings. Termination does not entitle you to a refund of any prepaid fees.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you disagree with changes, you may terminate your account.

15. Governing Law
